Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Dumpit mobile application ("App") operated by Dumpit ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

2. User Accounts

You may use parts of the App as a guest. To create an account, you must sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree not to use the App to:

• Upload, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Share any content that infringes on the intellectual property rights of others
• Upload explicit, sexual, or violent content involving minors
• Impersonate any person or entity or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Attempt to gain unauthorized access to any part of the App or its systems
• Use automated tools, bots, or scripts to access or scrape the App
• Violate any applicable local, national, or international law or regulation

4. User Content

You retain ownership of photos and content you upload ("User Content"). By uploading content, you grant Dumpit a non-exclusive, royalty-free, worldwide license to store, display, and transmit your content solely for the purpose of operating and providing the App's features (e.g., displaying photos in event albums to album members).

You represent and warrant that you own or have the necessary rights to the content you upload, and that your content does not violate any third-party rights or these Terms.

We do not claim ownership of your photos. We do not use your photos for advertising or train AI models on your content.

5. Subscriptions and Payments

Dumpit offers a free tier and an optional annual subscription ("Dumpit Pro") priced at $29.99 CAD per year. Subscriptions are managed through the Apple App Store and governed by Apple's payment terms.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel your subscription via your Apple ID account settings
• Refunds are subject to Apple's refund policy
• Promotional codes may provide a discount and are subject to their own terms

6. Guest Mode and Data Expiry

If you use the App as a guest (without creating an account), your photos and data associated with your guest ID will be automatically deleted 30 days after the event you joined has ended, unless you create a registered account before that date. We will send a push notification 3 days before expiry if you have granted notification permissions.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, film preset names, interface design, and software — are owned by Dumpit and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, Dumpit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
