Apple Notice. This End User License Agreement ("EULA") is between you and Dumpit — not Apple Inc. Apple is not responsible for the App or its content. This EULA complies with Apple's standard EULA requirements for App Store applications.
This EULA is a legal agreement between you ("User," "you") and Dumpit ("we," "us," "Licensor") for the use of the Dumpit mobile application ("App") on Apple iOS devices. By downloading or using the App, you agree to be bound by this EULA.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, and as permitted by the App Store Usage Rules set forth in the Apple Media Services Terms and Conditions.
This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

You agree that we may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — to facilitate the provision of software updates, product support, and other services related to the App. We may use this information to improve our products or provide services or technologies, as long as it is in a form that does not personally identify you. The App offers an optional annual subscription ("Dumpit Pro") available for purchase through the Apple App Store. All purchases are processed by Apple and subject to Apple's payment terms. We are responsible for all purchase-related support, including refund requests, which are governed by Apple's refund policy.
Dumpit is solely responsible for providing maintenance and support services for the App, as specified in this EULA or as required by applicable law. Apple has no obligation to furnish any maintenance or support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
Dumpit, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Dumpit (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App. For example, if you use a VoIP application, then you must not be in violation of their wireless data service agreement when using the App.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
This EULA is effective until terminated by you or us. Your rights under this EULA will terminate automatically without notice from us if you fail to comply with any term of this EULA. Upon termination, you must destroy all copies of the App in your possession.
This EULA is governed by the laws of the Province of Ontario, Canada, excluding its conflict-of-law provisions.
